Welcome to Evernight Society. These Terms & Conditions apply when you access our website or purchase products from us.

Throughout these terms, “we”, “us” and “our” refer to Evernight Society. By using our website or placing an order, you agree to these Terms & Conditions.

Nothing in these terms affects your statutory rights as a consumer.

1. ABOUT OUR PRODUCTS

We make every reasonable effort to display our products accurately, including their colours, designs and appearance.

Colours may appear slightly different depending on your screen or device.

As some Evernight Society products are individually finished by hand, minor variations in placement or finish may occur. These small variations are not necessarily faults.

Product availability may change, and we reserve the right to discontinue products or limit quantities available for purchase.

2. ORDERS

When you place an order, you are offering to purchase the products in your order.

After receiving your order, we will send confirmation electronically. We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, there has been an obvious pricing or listing error, payment cannot be authorised, or we reasonably suspect fraudulent activity.

If we cancel an order after payment has been taken, we will refund the appropriate amount.

Please check the information provided when placing your order, including your delivery address.

3. PRICES & PAYMENT

All prices are displayed in pounds sterling (£) unless otherwise stated.

The price payable will be the price displayed when you place your order, subject to correction of obvious pricing errors.

Any applicable delivery charges will be shown before you complete your purchase.

Payment must be successfully authorised before an order can be processed.

4. DELIVERY

Orders will be delivered to the address supplied during checkout.

Any processing or delivery times shown on our website are estimates unless expressly stated otherwise.

We are not responsible for delays caused by circumstances genuinely outside our reasonable control. However, nothing in these terms limits any delivery rights you have under applicable UK consumer law.

Please contact us if your order has not arrived within the expected timeframe so that we can investigate.

5. CANCELLATIONS, RETURNS & REFUNDS

Your cancellation, return and refund rights are explained in our Return & Refund Policy, which forms part of these Terms & Conditions.

For eligible online purchases, consumers normally have a statutory right to cancel within the applicable cancellation period.

This does not affect your statutory rights where goods are faulty, damaged or not as described.

6. PERSONALISED & CUSTOM PRODUCTS

Products made to your individual specifications or clearly personalised for you may not qualify for the usual change-of-mind cancellation right.

This exception does not apply merely because a standard product is made or finished after an order is received.

Your statutory rights still apply where personalised or custom products are faulty, damaged or not as described.

7. PRODUCT CARE

Where care instructions are provided with a product or on our website, please follow them.

We cannot accept responsibility for damage caused by misuse, inappropriate washing or cleaning, failure to follow supplied care instructions, or normal wear and tear. This does not affect your statutory rights concerning faulty goods.

8. INTELLECTUAL PROPERTY

Unless otherwise stated, Evernight Society owns or is authorised to use the branding, original graphics, photographs, website content and other original materials created for Evernight Society.

Our content may not be copied, reproduced, commercially exploited or presented as another business's work without permission, except where permitted by law.

Third-party names, trademarks and other intellectual property remain the property of their respective owners.

9. WEBSITE USE

You must not use our website for unlawful or fraudulent purposes or attempt to interfere with its operation or security.

You must not knowingly introduce viruses, malicious software or other harmful material.

We may restrict access to our website where reasonably necessary to protect the business, our customers or our systems.

10. THIRD-PARTY SERVICES

Our website may use services provided by third parties, including payment, ecommerce and delivery providers.

Evernight Society's online store is powered by Shopify.

Where you use a third-party service, that provider may also have its own applicable terms and privacy practices.

We handle personal information in accordance with our Privacy Policy.

12. LIABILITY

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under applicable consumer law.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase, to the extent permitted by law.
